Please
review the Agenda to determine if the subject you wish to discuss is scheduled
for Council consideration. If it is on
the Agenda, you will have an opportunity when that matter comes up for
discussion to briefly address the Council.
If
the subject is not on
tonight’s Agenda, please complete an Agenda Request Form (on Clerk’s
table) and present it to the City Council Clerk. You will have the opportunity to speak on the
subject under Item 5.2. However, if the
item is not on the Agenda, each speaker will be limited to one five (5) minute
opportunity to speak, unless the City Council makes an exception due to special
circumstances.
The
Brown Act prohibits the Council
from taking action on any item not placed on the printed Agenda in most
cases.
Effective
July 1, 2008, the Brown Act requires any non-confidential documents or writings
distributed to a majority of the City Council less than 72 hours before a
regular meeting will be made available to members of the public at the same
time they are distributed.
City
Council meetings are televised and can be seen live on Cable Public Access
Channel 11 and on tape delay the following morning at 10:00 a.m.
In
compliance with the Americans with Disabilities Act, the City of Anderson will
make available to members of the public any special assistance necessary to
participate in this meeting. The public
should contact the City Clerk’s office (378-6646) to make such a request. Notification 72 hours prior to the meeting
will enable the City to make reasonable arrangements to ensure accessibility to
this meeting.

7.0 PUBLIC HEARING – FORMATION OF COMMUNITY
FACILITIES DISTRICT 2009-1, VINEYARDS AT ANDERSON
RECOMMENDED
ACTIONS:
At the conclusion of the public hearing and
considering testimony received, the City Manager recommends that the City
Council:
1. Adopt
a Resolution of the City Council of the City of Anderson Approving and
Authorizing Execution of Two Separate
Joint Community facilities Agreements in Connection with the formation of
Community Facilities District 2009-1 (Vineyards at Anderson); and making
Certain Findings and Determinations in connection therewith
2. Adopt
a Resolution of the City Council of the City of Anderson Forming and
Establishing Community Facilities District No. 2009-1 (Vineyards at Anderson)
of the City of Anderson, and Authorizing Submittal of a Levy of Special Taxes Within the District to the Qualified Electors Thereof
3. Adopt
a Resolution of the City Council of the City of Anderson Deeming it Necessary
to Incur Bonded Indebtedness Within for Community Facilities District No.
2009-1 (Vineyards at Anderson)
4. Adopt
a Resolution of the City Council of the City of Anderson Calling A Special Election in Community Facilities District No.
2009-1 (Vineyards at Anderson)
After the Clerk tallies the ballots, and
if the ballots indicate the measures pass, the City Manager recommends that the
City Council:
5. Adopt a Resolution of the City Council
of the City of Anderson Declaring the Results of the Special Election for
Community Facilities District No. 2009-1 (Vineyards at Anderson) of the City of
Anderson on Propositions Regarding (a) Incurring a Bonded Indebtedness in an
Amount not to Exceed $45,000,000, (b) the Annual Levy of Special Taxes and (c)
Establishing an Appropriations Limit
6. Introduce an ordinance of the City
Council of the City of Anderson acting as the Legislative Body of Community
Facilities District No. 2009-1 (Vineyards at Anderson) of the City of Anderson,
and read by short title only, authorizing the Levy of a Special Tax in such
Community Facilities District, and place it on September 15, 2009, agenda for
enactment.
10.0 ADJOURN - The
City Council will adjourn to September 1, 2009.

Special Meeting of the Anderson City Council is hereby called by the
undersigned and under the authority vested in him by Section 54956 of the
Government Code of the State of California.
The meeting is to take place on Tuesday, August 25, 2009, at 6:30 p.m.
at the Anderson City Hall Council Chambers, 1887 Howard Street, Anderson,
California 96007.
The Anderson City Council hereby
provides the public with an opportunity to address the City Council on any item
described in the attached agenda before or during consideration of that
item. Only items described in the
attached agenda may be considered by the City Council at this special meeting.
